India Election Commission Row Referred to Supreme Court. ElectionGuide.
A month-long battle between the current Chief Election Commissioner of India and his soon-to-be successor is now under consideration by the Supreme Court. The dispute has left the upcoming parliamentary election preparations in limbo – Indian law stipulates that the new parliament must be elected by the end of May, but no election date has yet been set – and threatens to snowball into a full-blown constitutional crisis. Last month, Chief Election Commissioner N. GOPALASWAMI petitioned to remove Commissioner Navin CHAWLA, accusing him of "acting with bias in favor of the ruling Congress party." GOPALASWAMI will retire on April 20, just before the election is expected to take place, with CHAWLA scheduled to replace him as Chief Electoral Officer. Analysts say CHAWLA will in all probability become the next Chief Commissioner despite his predecessor's objections.
